6. AI-Generated Content Disclaimer

6.1 Artificial Intelligence Limitations

This Service uses artificial intelligence (AI) technology, including large language models (LLMs) such as GPT-4o. YOU ACKNOWLEDGE AND ACCEPT THAT AI TECHNOLOGY:

• Can and does generate errors, inaccuracies, and false information ("hallucinations")
• May produce plausible-sounding but factually incorrect medical information
• Can misinterpret, misrepresent, or incorrectly synthesize medical literature
• May provide outdated, incomplete, or biased information
• Cannot replace human medical expertise, clinical judgment, or professional training
• May generate contradictory or inconsistent responses to similar queries
• Lacks the ability to understand individual patient context, nuance, or complexity
• Is not validated for clinical decision-making or patient care

6.2 No Validation or Clinical Testing

The AI outputs provided by this Service have NOT been:

• Validated through clinical trials or rigorous medical testing
• Approved by any regulatory authority (FDA, EMA, etc.)
• Reviewed or endorsed by medical professional organizations
• Verified for accuracy, safety, or clinical appropriateness
• Tested for use in actual patient care scenarios

6.3 Non-Deterministic Responses

AI-generated responses are probabilistic and non-deterministic. The same query may produce different responses at different times. You cannot rely on consistency, reproducibility, or reliability of AI outputs.

7. Third-Party Content and Data Sources

This Service aggregates and synthesizes information from third-party sources, including but not limited to:

• PubMed and NCBI medical literature databases
• OpenAI's GPT-4o and other AI models
• Published medical research papers and abstracts
• Medical databases and online resources

WE ARE NOT RESPONSIBLE FOR:

• The accuracy, completeness, or reliability of third-party content
• Errors, omissions, or inaccuracies in source materials
• Retracted, corrected, or updated research findings
• Biases, conflicts of interest, or methodological flaws in published research
• Availability or accessibility of third-party services

All citations, references, and source materials must be independently verified through original publications.

9. Limitation of Liability - Maximum Legal Protection

9.1 No Liability for Any Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GASCONSULT.AI, ITS OWNERS, OPERATORS, DEVELOPERS, CONTRIBUTORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND AGENTS (COLLECTIVELY, "RELEASED PARTIES") SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

• Direct damages
• Indirect damages
• Incidental damages
• Consequential damages
• Punitive damages
• Special damages
• Exemplary damages
• Loss of profits, revenue, business, data, or opportunities
• Personal injury or death
• Medical malpractice or negligence
• Reliance damages
• Emotional distress

9.2 No Liability for Medical Outcomes

THE RELEASED PARTIES SHALL NOT BE LIABLE FOR:

• Patient injuries, complications, adverse events, or death
• Medical errors or clinical mistakes based on information from this Service
• Misdiagnosis, delayed diagnosis, or failure to diagnose
• Inappropriate treatment or medication errors
• Harm resulting from reliance on AI-generated content
• Errors, omissions, or inaccuracies in provided information
• Outdated, incomplete, or misleading medical information
• Failure to seek timely professional medical care
• Deviation from standard of care based on Service content

9.3 Maximum Liability Cap

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE RELEASED PARTIES EXCEED THE GREATER OF (A) ZERO DOLLARS ($0.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO GASCONSULT.AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Since this Service is provided free of charge, the maximum liability is $0.00.

9.4 Limitations Apply to All Claims

These limitations apply to all claims, regardless of whether they are based on:

• Warranty, contract, tort (including negligence), strict liability, or any other legal theory
• Whether or not the Released Parties have been advised of the possibility of such damages
• Whether a remedy fails of its essential purpose

10. Indemnification - You Hold Us Harmless

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL:

• Claims, demands, actions, suits, or proceedings
• Losses, damages, liabilities, settlements, penalties, fines, or judgments
• Costs and expenses (including reasonable attorneys' fees, expert fees, and litigation costs)

ARISING from or related to:

• Your use or misuse of this Service
• Clinical decisions, treatments, or patient care based on information from the Service
• Medical malpractice or negligence claims related to your use of the Service
• Your violation of these Terms of Service
• Your violation of any applicable laws, regulations, or professional standards
• Your violation of any rights of third parties
• Any representation or warranty made by you to patients or third parties regarding this Service
• Your failure to independently verify information provided by the Service
• Patient harm resulting directly or indirectly from your use of the Service

This indemnification obligation survives termination of your use of the Service.

11. Assumption of Risk - You Accept All Risks

BY USING THIS SERVICE, YOU EXPRESSLY ACKNOWLEDGE, UNDERSTAND, AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH:

• Reliance on AI-generated medical information
• Potential inaccuracies, errors, or omissions in provided content
• AI hallucinations and false information generation
• Outdated or incomplete medical information
• Misinterpretation of medical literature or research findings
• Service unavailability, downtime, or technical failures
• Security vulnerabilities or data breaches
• Third-party content errors or inaccuracies
• Consequences of any clinical decisions informed by this Service

YOU ACCEPT FULL AND SOLE RESPONSIBILITY FOR ALL RISKS ASSOCIATED WITH YOUR USE OF THIS SERVICE.

12. HIPAA and Protected Health Information (PHI)

12.1 Not a HIPAA Covered Entity

GASCONSULT.AI IS NOT A COVERED ENTITY OR BUSINESS ASSOCIATE UNDER THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPAA).

We do not provide healthcare services, maintain medical records, or engage in activities that would classify us as a HIPAA-covered entity.

12.2 DO NOT Enter Protected Health Information

YOU MUST NOT ENTER, SUBMIT, OR UPLOAD ANY PROTECTED HEALTH INFORMATION (PHI) OR PERSONALLY IDENTIFIABLE HEALTH DATA INTO THIS SERVICE.

This includes but is not limited to:

• Patient names, initials, or identifying information
• Medical record numbers or patient identifiers
• Dates of birth, addresses, or contact information
• Social security numbers or insurance information
• Specific medical histories or case details that could identify a patient
• Any of the 18 HIPAA identifiers

12.3 Your HIPAA Compliance Responsibility

If you are a HIPAA-covered entity or business associate, YOU ARE SOLELY RESPONSIBLE for ensuring your use of this Service complies with all HIPAA requirements. We assume no responsibility for your HIPAA compliance.

13. Regulatory Status and FDA Disclaimer

13.1 Not an FDA-Approved Medical Device

THIS SERVICE IS NOT AN FDA-APPROVED, FDA-CLEARED, OR FDA-REGISTERED MEDICAL DEVICE.

This Service has not been evaluated, approved, or cleared by the U.S. Food and Drug Administration (FDA) or any other regulatory authority.

13.2 Not Intended for Clinical Use

This Service is not intended to:

• Diagnose, treat, cure, or prevent any disease
• Be used in the diagnosis of disease or other conditions
• Be used in the cure, mitigation, treatment, or prevention of disease

13.3 No Professional Endorsement

This Service is not endorsed, approved, or recommended by:

• The American Society of Anesthesiologists (ASA)
• The American Association of Nurse Anesthetists (AANA)
• Any medical professional organization or licensing board
• Any hospital, healthcare system, or medical institution
• Any governmental health agency or regulatory body

14. Dispute Resolution - Mandatory Binding Arbitration

14.1 Agreement to Arbitrate

YOU AND GASCONSULT.AI AGREE THAT ANY AND ALL DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT.

14.2 Arbitration Procedures

Any arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and conducted in accordance with the following:

• The arbitration shall be conducted by a single neutral arbitrator
• The arbitration shall take place in Delaware, United States
• The arbitration shall be governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.)
• The arbitrator's decision shall be final and binding
• Judgment on the arbitration award may be entered in any court having jurisdiction
• Each party shall bear its own costs and attorneys' fees

14.3 Waiver of Jury Trial

YOU HEREBY IRREVOCABLY WAIVE ANY AND ALL RIGHTS TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE.

14.4 Waiver of Class Actions

YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. Class Action Waiver

YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, OR MASS ACTION AGAINST GASCONSULT.AI.

You agree that:

• You will not seek to bring or participate in any class, collective, or representative action
• You will not serve as a class member, representative, or opt into any class proceeding
• All claims must be brought in your individual capacity only
• You waive any right to have claims consolidated with claims of other users

16. Governing Law and Jurisdiction

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

16.2 Jurisdiction and Venue

To the extent any dispute is not subject to arbitration, you agree to submit to the exclusive personal jurisdiction and venue of the state and federal courts located in Delaware, United States.

16.3 International Users

This Service is controlled and operated from the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

17. Severability and Waiver

17.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction:

• The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable
• If modification is not possible, the invalid provision shall be severed from these Terms
• The remaining provisions shall remain in full force and effect
• The invalid provision shall not affect the validity or enforceability of any other provision

17.2 No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless made in writing and signed by an authorized representative of gasconsult.ai.

18. Changes to Terms

We reserve the right to modify, amend, or update these Terms at any time, in our sole discretion, with or without notice.

Changes shall be effective immediately upon posting to this page.

Your continued use of the Service after any changes constitutes your acceptance of the modified Terms. You are responsible for regularly reviewing these Terms. If you do not agree to modified Terms, you must immediately cease using the Service.
